Last updated: 13 October 2026

This Privacy Policy explains how personal data submitted through montclarecapitalfinancing.com is collected, used and protected, in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, “GDPR” / in the Netherlands, the “AVG”).

1. Data Controller

The data controller responsible for the processing of your personal data is:

Montclare Capital Partners B.V.
Willem Fenengastraat 16E, 1096 BN Amsterdam, The Netherlands
Chamber of Commerce (KvK): 97743054
VAT (BTW): NL868211527B01
Email: info@montclarecapitalfinancing.com

Montclare Capital Financing is a registered trade name (handelsnaam) under which the above entity operates. It is not a separate legal entity.

2. What data we collect

When you submit a financing enquiry through this website, we may collect:

The fields marked as required on the enquiry form are the ones we need in order to assess the enquiry at all. Providing them is not a legal obligation, but without them we cannot assess your requirement or respond on the merits. Anything else you add is voluntary.

We do not knowingly collect special categories of personal data. Please do not include such data in your enquiry.

3. Purpose and legal basis

We process your personal data for the following purposes, each on a single legal basis under Article 6 GDPR:

Submitting an enquiry does not constitute a financing application or any commitment on either side.

We do not take decisions about you based solely on automated processing, and we do not profile you, within the meaning of Article 22 GDPR. Your file is read and assessed by a person.

4. Sharing of data

Where a case is suitable for further assessment, and only where appropriate, your data may be shared with:

We do not sell personal data. Your enquiry data is processed within the European Economic Area. One exception applies, and it concerns the website rather than your enquiry: the analytics described in section 8 are provided by Google, which may process that data in the United States. Those transfers rely on the European Commission’s adequacy decision of 10 July 2023 for the EU-US Data Privacy Framework, to which Google LLC is certified, supplemented by the Commission’s standard contractual clauses. If any other processor outside the EEA is engaged, it will be subject to the safeguards required under Chapter V GDPR.

5. Retention

We retain enquiry data only for as long as necessary to assess and respond to your enquiry and, where applicable, for the duration of any resulting relationship, plus any period required by law. Enquiries that do not proceed to a relationship are deleted within 24 months.

6. Your rights

Under the GDPR you have the right to access, rectify, erase, restrict or object to the processing of your personal data, the right to data portability, and the right to withdraw consent where processing is based on consent. To exercise these rights, contact us at info@montclarecapitalfinancing.com.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl).

7. Hosting and security

This website is hosted on infrastructure located in the Netherlands (European Union). We apply appropriate technical and organisational measures to protect your data.

8. Cookies

This website uses as few cookies as it can. One is set by us and is functional; the rest are analytics cookies (Google Analytics 4) and are placed only if you accept them. We do not use advertising cookies and we do not track you across other websites.

Analytics are denied by default. Until you press Accept, Google Consent Mode keeps analytics storage switched off: no analytics cookie is placed and no measurement is recorded. The Google script itself is loaded with each page, so Google receives the technical connection data that any request to a server involves, including your IP address. IP anonymisation is enabled, and Google Signals and advertising personalisation are switched off.

Withdrawing your consent. Your choice is stored in your browser’s local storage under the key mc-consent-v1, not in a cookie, so clearing your cookies does not undo it. Use this button instead: it erases the stored choice and the banner will ask you again.

9. Changes

We may update this Privacy Policy from time to time. The current version is always available on this page.
